TERMS OF COMMERCE
All manufacturers names, numbers, symbols and descriptions are used for reference purposes only and do not indicate affiliation, endorsement, or sponsorship.
Payment for orders are prepaid before dispatch. All property is sold “AS IS, WHERE IS”. Neither Dean Resources Ltd. nor the consignor if applicable makes any representation of warranty, oral or written expressed or implied, as to the merchantability, fitness for a particular purpose, condition of the property, correctness of the description, condition, capacity, age or any other details used to describe the property. Absolutely NO RETURN of sold goods, NO REFUNDS, and NO EXCHANGES will be permitted.
Dean Resources Brokering Terms
Where Dean Resources Ltd. sells Goods as an Agent for the Owner of the Goods, Dean Resources Ltd. makes no representations and gives no warranties:
(a) regarding the fitness for purpose, condition or quality of Goods; or
(b) regarding title to the Goods, including whether or not title to the Goods resides with the owner.
Buyer must pay Dean Resources Ltd. initial agreed upon commission on any purchase of Goods that was originally introduced by Dean Resources Ltd. for a period of 2 years, from date of introduction.
Seller must pay Dean Resources Ltd. initial agreed upon commission on any sale of Goods that was originally introduced to purchaser by Dean Resources Ltd. for a period of 2 years from date of introduction.
Drawings and specifications
All drawings, specifications, descriptions and other documents attached to any quotation are for tendering purposes only and will not form the basis of nor be part of any contract between the Customer and Dean Resources Ltd.. After receipt of the Customer's orders, Dean Resources Ltd. will provide, if it has agreed in writing to do so, copies of available drawings, specifications and manuals. The details contained therein will be submitted in good faith as being correct but any errors, omissions or defects therein will not be grounds for cancellation of the contract nor entitle the Customer to make any claim against Dean Resources Ltd.. All additional manuals, drawings or documentation requested by the Customer will be at the Customer's expense.
